市場監管總局近日發佈《集中用餐單位落實食品安全主體責任監督管理規定》,自2025年4月15日起施行。

There are a total of 27 articles in the "Regulations", which stipulate the distribution of responsibilities, risk prevention and control mechanisms, food safety management personnel and job requirements, and legal responsibilities for centralized dining units, unit canteens, contracted business enterprises, and catering units. The main contents are as follows:
The first is to strengthen the food safety management responsibility of centralized dining units. It is stipulated that centralized dining units shall strengthen the management of the business activities of unit canteens, contracted business enterprises, and catering units in accordance with the law; When determining the contracted business enterprises and catering units, it is necessary to select the enterprises that have obtained the food business license; If you order food from a catering unit, you must check the food ordered as required. It is clarified that if the centralized dining unit fails to perform its food safety management responsibilities, it shall be punished in accordance with law.
The second is to clarify the main responsibility for food safety of unit canteens, contracted enterprises, and catering units. It is stipulated that the canteens, contracted enterprises, and catering units shall establish and improve the food safety management system, implement the food safety responsibility system, and appoint food safety directors and food safety officers in accordance with the law; At the same time, taking into account the particularity of schools and kindergartens, it is stipulated that schools and kindergartens that meet certain conditions are entrusted with contract management, and schools and kindergartens should also be equipped with food safety directors. The rules stipulate that unit canteens, contracted enterprises, and catering units must strictly implement the work system of "daily control, weekly inspection, and monthly scheduling". It is clear that schools and kindergartens that violate the requirements of the "Provisions" shall be dealt with severely.
The third is to improve the working mechanism for the coordinated implementation of food safety responsibilities by all relevant subjects. The regulations require that centralized dining units shall sign contracts with contracted business enterprises and catering units in accordance with the law, clarify the obligations of both parties in terms of food safety, establish a food safety consultation mechanism, communicate regularly, jointly investigate and eliminate potential safety hazards, and prevent and control food safety risks; If there is a potential risk of food safety accidents, all relevant entities shall immediately stop catering service activities and report in accordance with regulations.
