Millions of new houses are hundreds of graves outside the windows: owners say they have been fooled, and developers have built 15-meter-high walls

A number of owners in Beijing No. 1 Block, Gemdale District, Tongzhou District, recently reported to reporters that the delivery of the new house was imminent, but they found that the expected green house with a beautiful environment had become a "grave view house". "When you open the window, there are hundreds of graves right under your nose." The nearest residential building is located just about 30 meters from the cemetery. The owner was stunned and was fooled by the developer's "announcement of moving the grave". The reporter went to the scene to understand the situation.

The residential building is only about 30 meters away from the cemetery

"Recently, the house is closing and I am looking forward to seeing my new home. But as soon as I came, I was dumbfounded, and under the window was a large cemetery. Mr. Wang, the owner, said, and took the reporter to the cemetery outside the community. Hundreds of tombstones are scattered high and low, the graves are very compact between them, and some of them have offerings in front of them. According to the inscription, the reporter notes that the newer of these tombstones was erected in 2024 years.

Looking out from the house, the tombstones are densely packed

On the north side of the cemetery is the residential area of Lot 30 in the first block of Jindi, and the distance between the cemetery and the residential building is only about 0 meters. "The community is still in the final stages of construction, and it is about to be closed." Mr. Wang said that his long-awaited new home had become a "grave room", which made him feel very bad.

The residential area is located just about 30 meters from the cemetery.

According to the owner, there are about 30 residents in Lot 0, of which there are 0 buildings with more than 0 residents who "open the windows to see the grave", and their vision is directly affected by the cemetery on the south side. The cemetery is also visible to the residents of other buildings, but it is somewhat obscured. "The middle building is the king of the building, when I bought the house, I deliberately chose the best location, thinking that the opposite side was a green space, but I didn't expect that when the house was handed over, it became hundreds of tombstones."

Mr. Wang reluctantly said that when he looked at the house, he took a fancy to the good environment here, "There are a lot of art blocks planned around, and the salesman also organized us to visit the nearby art studios and visit some artists, and the atmosphere is very good." When you buy a house and look at the sand table, the south side of the community on the sand table is also a green space. The house was originally bought for the elderly, but now they dare not mention the new house to the elderly. ”

The reporter visited the middle-rise and high-rise residents respectively, and looked through the window and saw a lot of tombstones in the line of sight. Mr. Wang said that the south window is not obstructed, and it is the window with the best ventilation, lighting and view, but now not only the scenery has become a grave scene, but also the safety issue worries him. "With so many tombs, it is inevitable that some people will come to pay respects, and once there is an open flame burning paper, it may cause a fire."

Promised to "definitely move out" before buying a house

It is understood that Gemdale Beijing One Block was started by Beijing Gemdale Tongda Real Estate Development Co., Ltd. in 30 years, characterized by low-density houses, the first and second phases of residential buildings have been delivered, and the third phase of the No. 0 plot is expected to be delivered on 0 on 0.

The owner, Mr. Huang, told reporters that he bought the off-plan house in the community in 2023 years, and the house was still under construction at that time, and he could only see the approximate location of the community. When he surveyed his surroundings, he did not find a cemetery across the road from the south side of the community. "At that time, the construction site was surrounded by a very high fence, and I couldn't see the situation inside." He told reporters that in the unfavorable factors clause around the project in the contract, it was indeed mentioned that there is a current cemetery on the northeast and south sides of the community, which may have a visual impact. But the specific location, area and distance were not specified, and the salesperson did not clearly indicate it. It wasn't until I went to the scene near the handover and looked down from the upper floor that I realized that the cemetery was so close. ”

Some owners also said that they had learned that there was a cemetery on the south side of the community when they bought the house, so they specially consulted. "But the salesperson swore that the cemetery would be moved, and I decided to pay for the purchase."

According to the information provided by the owner, the salesperson has repeatedly promised that the cemetery will be moved away before the handover of the house, and will not have any impact on the quality of living, and said that he has confirmed with the relevant departments that he has contacted relatives to claim and register the grave, and issued an announcement on the relocation of the grave. In order to reassure the owner, the notice of relocation was also shown to the owner.

The owner, Ms. Lin, was still not at ease at that time, and went to the scene to verify, and found that such a notice was indeed posted on the iron gate in front of the cemetery, so she took a "reassuring pill" and finally paid the purchase price. But two years have passed, and the house is about to be handed over, and the cemetery on the south side of the community has not only not been moved, but there are more and more graves.

A paper "relocation announcement" fooled people

The delivery is imminent, but there is no movement at all in the promised relocation of the grave. The owners contacted the sales office, and Ms. Lin said: "The sales staff still firmly said that they would definitely move out. It is only ambiguous when it comes to the exact timing of the removal. "The anxious owner looked around," and when I inquired, I realized that we had been fooled by the developer. ”

The owner learned from the People's Livelihood Security Office of Songzhuang Town that the cemetery on the south side of the community is a centralized burial site in Daxingzhuang Village, which is historically formed, more than 358 years earlier than the development of the community, and is the only centralized burial site in the village, which belongs to the collective land of the village and is forest land in nature. A total of 0 tombs have been built, and the number of buried tombs is 0. At present, there is no special land in the village that can be used for the relocation of centralized burial sites.

In this case, what about the announcement of the relocation of the grave shown by the salesperson to the owner before?

The reporter noticed that the sales staff had shown the owner the announcement of moving the grave in 31 and 0 years. However, a closer look at this announcement shows that "due to the construction of the first-level land development project in Shuangbutou Village, Dapang Village, Daxingzhuang Village and other villages in Songzhuang Town, Tongzhou District, it is necessary to occupy the Daxingzhuang Village Cemetery, and there are 0 tombs in the cemetery, and there are currently 0 tombs that cannot be claimed by relatives." Due to the tight construction period of the project, please contact the town government before 0 year 0 0 for the unregistered tombs within the cemetery. At that time, if no contact is made, the local village committee will handle the relocation of the tomb on behalf of the local village committee. ”

Ms. Lin told reporters that the announcement she saw outside the iron gate of the cemetery was similar, and it also stated that it was required to contact and claim the grave within one year, but the payment time was at the end of 2021, "I looked at the time and thought that the relocation work had begun, and our third phase of delivery was relatively late, which is basically consistent with the developer's promise that it will move out before moving in." ”

Mr. Liu said that although the salesperson informed the existence of the cemetery when he bought the house in 2023 years, he claimed that there were still some scattered graves that needed to be claimed by relatives, and combined with the information in the announcement, it could also be justified. "It wasn't until now that we realized that the announcement was actually confusing the public."

In order to confirm this matter, the reporter asked the local people's livelihood security office, demolition and relocation office, village committee and other relevant units for verification. Previously, the staff responsible for the relocation of scattered graves told reporters that the relocation of graves in the early stage of the project construction was carried out by a third-party company. The company's staff said that the company is responsible for the primary development of the land, that is, the consolidation of the land, and the land acquisition and demolition by Songzhuang Town, involving the area within the current "red line" of the community, and the final determination of the developer through auction after the land consolidation is completed. The company is only responsible for the area within the "red line" of the community, and it is not clear what the current plan is for centralized burial sites outside the "red line" of the community.

The staff of the village committee of Daxingzhuang Village also said that they were only told that part of the cemetery would be occupied at that time, and it was not clear whether the current centralized burial site needed to be moved.

The developer erected a 15-metre high wall

Now that we have come to this, how should the problem be solved? The relevant person in charge of the developer explained to the owner that Gemdale has been working hard to negotiate with relevant departments since the development and construction, and is willing to promote the resolution of the matter by investing funds or other means, but due to various factors, it has still not been reached.

Regarding the previous promise of the salesperson to move the grave before moving in, the person in charge argued that the company did not deliberately mislead the owner, "Word of mouth, some people say so, the salesperson may think that is the case." ”

In this regard, the owner consulted the Tongzhou District Civil Affairs Bureau, the Tongzhou Branch of the Planning and Self-Commission, the Tongzhou District Landscaping Bureau and other units, all of which said that the centralized burial site here was a forest land occupied without approval. At the same time, the staff of the Songzhuang Town People's Livelihood Security Office and the village committee also said that this is the only centralized burial site in Daxingzhuang Village, and there is nowhere to move the grave in the village. Considering the actual needs of the village, it can only be temporarily resettled here. The owner of the community told reporters that everyone understands this, but cannot accept the false promises made by the developer when he buys the house.

After consultation with the Daxingzhuang Village Committee, the developer of the community decided to build a high wall around the centralized burial site to block the view of the community residents to a certain extent. When the reporter visited the site, he saw that a fence was being built on the side of the cemetery close to the community. As of press time, a 15-meter-long and 0-meter-high wall has been erected.

However, this practice has not been recognized by the owners and villagers of the community. The owners believe that the developer has built a wall to treat the symptoms rather than the root cause, and the villagers also believe that the burial site is now cramped. Everyone wants a better solution. This newspaper will continue to pay attention to this matter.
